Welcome to the 2023 G90 Welcome Experience Program (“Program”). Harris Marketing Group, Inc. (“Harris”), administers the Program on behalf of Genesis Motor America (“Genesis”). Please carefully read these Terms and Conditions ("Terms and Conditions") and pay attention to specific terms from one Experience to the other, as noted. Together these Terms and Conditions constitute the entire agreement regarding the Program and set forth the legally binding terms governing your participation in the Program. The Terms and Conditions apply to all persons who participate in the Program, regardless of level of participation.

For a limited time, eligible 2023 G90 owner/lessees are being offered a Genesis Welcome Experience that includes their choice of one of two experiences: the Genesis House Experience, the 2024 Genesis Invitational PGA Golf Tournament Experience. Along with these Terms and Conditions, there are additional unique terms that apply to the Genesis House Experience and the 2024 Genesis Invitational PGA Golf Tournament Experiences, that are noted below.

You are eligible to participate in the Program if you purchased or leased a new 2023 G90 (the “Vehicle”) from a participating Genesis retailer in the United States or District of Columbia. You must be a licensed driver, eighteen (18) years or older as of the date of your purchase or lease. (The forgoing terms constitute an “Eligible Customer”)

The Program is only available for redemption upon retail delivery of the Vehicle by a Genesis retailer to an Eligible Customer during the Program Period December 22, 2022, until December 31,2023. The Genesis G90 Welcome Experience offered in connection with the Program must be accepted upon your initial choice of Experience and as awarded, does not have any cash surrender value, cannot be exchanged, or returned and is subject to change without notice.

The Genesis House Experience. If you choose the Genesis House Experience the following additional terms apply. You must make your Genesis House reservation through the Genesis G90 Welcome Experience Curator (888-526-1230) and you will receive an email confirmation of your reservation following the call. Reservations must be made before 11:59 pm ET on December 31, 2023.

The 2024 Genesis Invitational PGA Golf Tournament Experience. If you choose the 2024 Genesis Invitational PGA Golf Tournament Experience the following additional terms apply. You must make your reservation for the Genesis Invitational PGA Golf Tournament no later than December 31, 2023. You will make your reservation with a Genesis G90 Welcome Experience Curator and will receive an email confirmation following the call. Two (2) digital tickets will be sent out by the end of January 2024.  A Genesis G90 Welcome Experience Curator will remind you of your upcoming Genesis Invitational PGA Golf Tournament Experience, along with parking instructions for the event. Tickets must be accepted as awarded and do not have any cash surrender value. Neither Harris, Genesis, Hyundai Motor America, any service providers, or the PGA (“Genesis Invitational PGA Golf Tournament Releasees”) shall be legally responsible for any damages or injuries for the acts or omissions of the Genesis Invitational PGA Golf Tournament Releasees, nor shall the Genesis Invitational PGA Golf Tournament Releasees be subject to any legal process, nor bear any liabilities of any kind, be they financial or otherwise, related in any way to the 2024 Genesis Invitational PGA Golf Tournament Experience. You agree by booking your reservation to release the Genesis Invitational PGA Golf Tournament Releasees from any responsibilities or claims for cancellations, delays, or rescheduling of the event, or if you miss the event.

The eligibility for choosing one of the two Genesis Experiences is detailed above in these Terms and Conditions and applies to eligible 2023 G90 owner/lessees, only.

Your choice of the 2024 Genesis Invitational PGA Golf Tournament Experience will be redeemed in the form of Digital Tickets (sometimes referred to as the “Tickets” or “Digital Tickets”). Use of the Tickets is subject to all restrictions stated in these Terms and Conditions, the supplemental terms applicable to your Experience choice, as well as to any additional terms and conditions as stated on the Tickets and/or as otherwise stipulated by Genesis. The 2023 G90 Welcome Experience provided in connection with this Program and use of the Tickets is subject to all applicable local, state, and federal laws and is void where prohibited or restricted by law. Eligible Customers will receive one experience for two people per Vehicle purchased or leased from a participating Genesis retailer in the United States during the Program Period in accordance with these Terms and Conditions. Your chosen Genesis Experience and Tickets cannot be combined with any other offers, rebates, or incentives, or altered in any way. All expenses and costs not covered by the Tickets (including but not limited to, travel, lodging, and all other costs incurred in connection with redemption or use of the Tickets by an Eligible Customer) are the Eligible Customer's sole and absolute responsibility. FOR THE AVOIDANCE OF ANY DOUBT, NONE OF THE RELEASEES (AS DEFINED BELOW), NOR ANY OTHER ENTITY WILL BE PROVIDING ANY COMPENSATION WITH RESPECT TO ANY COSTS ASSOCIATED WITH REDEEMING OR OTHERWISE USING DIGITAL TICKETS. Eligible Customers are solely responsible for redeeming the Tickets with the applicable 2023 G90 Welcome Experience Curator team. Eligible Customers who participate in the Program consent to having any personally identifiable information that they have submitted used by Genesis, Harris, as well as any third-party service provider Harris has engaged, to provide your chosen Genesis Experience and Tickets in accordance with carrying out the terms of the Program. Genesis or Harris, as well as any third-party service provider, processes the personally identifiable information in accordance with the privacy statement on https://www.genesis.com/us/en/my-privacy-rights.html. Each of Harris, Genesis, or any other third-party service providers involved with this Program: (i) shall remain the sole and exclusive owner/lessees of all right, title, and interest in and to each of their respective patents, trademarks, trade names, service marks, copyrights, and all other intellectual property rights, and (ii) are not sponsors or affiliates of this Program unless specifically noted. None of the Releasees (as defined below) makes any representation or offers any warranties, express or implied, as to the quality or fitness of any 2023 G90 Welcome Experience provided in connection with the Program. To the fullest extent permitted by applicable law, each Eligible Customer who is a confirmed Genesis Experience recipient understands and acknowledges that he or she may not seek reimbursement or pursue any legal or equitable remedy from either Genesis, Harris, or any of the Releasees (as defined below) should his/her Genesis Experience fail to be fit for its purpose or is in any way unsatisfactory. For greater certainty and the avoidance of any doubt, by accepting a Genesis Experience, each Eligible Customer who is a confirmed Genesis Experience recipient agrees to waive all recourse against the Releasees (as defined below) if his/her Genesis Experience or a component thereof does not prove satisfactory, either in whole or in part. All rights not expressly granted in these Terms and Conditions are reserved. An Eligible Customer may not combine the Tickets received through the Program with any other Ticket(s), private or commercial offers, owner/lessees' loyalty and/or other programs. Tickets may only be transferred to another individual living in the same household as the Eligible Customer. Nontransferable out of household. Must redeem using original Tickets; no duplicates or facsimiles accepted. Purchase and lease agreements executed outside the Program Period are not eligible for this Program.

By participating in the Program, you agree that you will defend, release, indemnify and hold harmless Genesis, Hyundai Motor America, Harris, and any other third-party service providers involved with the provision of the Program, and each of their respective shareholders, officers, directors, employees, agents, affiliates and subsidiaries (collectively, the "Releasees"), from and against any and all liabilities, claims, damages and expenses whatsoever, including without limitation property damage, personal injury and/or death (including reasonable attorneys' fees and costs) arising out of your participation in the Program – including, but not limited to, your breach or alleged breach of these Terms and Conditions, your use or misuse of the Tickets, your participation in any Program-related activity (including preparation for, travel to, and/or use or misuse of the Tickets or the 2023 G90 Welcome Experience) and/or your breach or alleged violation of the patents, copyright, trademark, trade name, service mark, proprietary or other rights of third parties. In no event shall the Releasees be responsible or liable for any damages or losses of any kind arising out of Eligible Customers 'participation in the Program, including any injuries, claims or damages resulting from participation in the 2023 G90 Welcome Experience and/or redeeming the Tickets. These Terms and Conditions are governed by, and construed in accordance with, the laws of the State of California, regardless of principles of conflicts of laws that may require the application of the laws of another jurisdiction. Any action seeking legal or equitable relief arising out of or relating to the Program or these Terms and Conditions shall be brought only in the courts located in Orange County, California. You hereby irrevocably consent to the personal jurisdiction of said courts and waive any claim of forum non-convenience or lack of personal jurisdiction they may have. Genesis’, Harris’, and their affiliates’ failure to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. An Eligible Customer must mention he or she is part of the Program at the time of booking and present a valid Ticket upon check-in. All 2023 Welcome Experiences are subject to availability and may be modified at the discretion of Genesis at any time and without notice. Genesis is not responsible in any manner if any 2023 G90 Welcome Experience cannot take place, or if any Experience cannot be awarded due to travel cancellations, delays or interruptions due to acts of God, acts of war, natural disasters, public health crises, epidemics, pandemics, travel restrictions, government restrictions or bans, acts of public authorities, weather or acts of terrorism. ANYONE DEEMED BY GENESIS TO BE IN VIOLATION OF GENESIS’ INTERPRETATION OF THE LETTER AND/OR SPIRIT OF THESE TERMS AND CONDITIONS FOR ANY REASON IS SUBJECT TO DISQUALIFICATION AND WILL BE DEEMED INELIGIBLE FOR PARTICIPATION AT THE SOLE AND ABSOLUTE DISCRETION OF GENESIS AT ANY TIME. The Releasees will not be liable for: (i) any failure during the Program; (ii) any technical malfunction or other problems of any nature whatsoever; (iii) the failure of any information to be received, captured, or recorded for any reason whatsoever; (iv) anyone being incorrectly and/or mistakenly identified as a Genesis Experience recipient; (v) any errors; and/or (vi) any combination of the above.

Genesis reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Program (or to amend these Terms and Conditions) in any way, at any time, for any reason, in its sole discretion, including but not limited to any cause beyond the reasonable control of Genesis that interferes with the proper conduct, administration, security or fairness of this Program as contemplated by these Terms and Conditions, including, without limitation, any error, problem, computer virus, bugs, tampering, unauthorized intervention, fraud or failure of any kind whatsoever. Any attempt to undermine the legitimate operation of this Program in any way (as determined by Genesis in its sole and absolute discretion) may be a violation of criminal and civil laws, and should such an attempt be made, Genesis reserves the right to seek remedies and damages to the fullest extent permitted by law. Genesis reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Program, or to amend these Terms and Conditions, in any way without prior notice or obligation, in the event of any accident, printing, administrative or other error of any kind, or for any other reason whatsoever. Genesis reserves the right, in its sole and absolute discretion, to adjust any of the dates, timeframes and/or other mechanics stipulated in these Terms and Conditions, to the extent deemed necessary by Genesis, for purposes of verifying compliance by any Eligible Customer and/or other information with these Terms and Conditions, or as a result of any technical or other problems, or in light of another circumstances that, in the opinion of Genesis, in its sole and absolute discretion, affect the proper administration of the Program as contemplated in these Terms and Conditions, or for another reason. In the event of any discrepancy or inconsistency between these Terms and Conditions and disclosures or other statements contained in any Program-related materials, these Terms and Conditions shall prevail, govern, and control to the fullest extent permitted by law. The invalidity or unenforceability of any provision of these Terms and Conditions shall not affect the validity or enforceability of any other provision. If any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms and Conditions shall otherwise remaining effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein. Images on the website are for information purposes only and may not necessarily represent the exact Genesis Experience or Genesis Vehicles available.

All expenses and costs not listed as covered by these Terms and Conditions and/or the Tickets are the Eligible Customer's sole and absolute responsibility. Conditions and restrictions apply.

TICKET DISCLAIMER. Valid for a one-day event only. Eligible Customer must mention he or she is part of the 2023 G90 Welcome Experience program at time of booking and present a valid Ticket upon check-in. No facsimiles, no assignments. Unauthorized reproduction of Tickets is unlawful. Valid for new bookings only and does not apply to existing reservations and cannot be combined with any other offer, discount, or group booking. Limit of two (2) Tickets per booking per vehicle. Voucher Tickets cannot be combined. Reservations are subject to availability. Blackout periods may apply.
